Trade-marks Office consultation on proposed practice changes; June 11, 2009 deadline

Canada’s Trade-marks Office (TMO) is seeking comments on proposed changes to some aspects of TMO practice. The deadline to submit comments is June 11, 2009.

The proposed changes are:

1. Increasing the time to respond to office actions from four (4) months to six (6).

2. The TMO will no longer set deadlines to respond to TMO correspondence  advising of deficiences that must be addressed before a trade-mark application/registration is transferred to a new owner. However, the TMO will not register or recognize transfers until the defiencies are remedied.

3.  The TMO will no longer issue courtesy letters to trade-mark applicants advising of co-pending and confusing trade-mark applications with later filing or priority dates.  Such courtesy letters are useful for alerting trade-mark owners of applications which they may want to oppose.
